RRC/New York: El juez Brian Cogan, de la Corte Federal del Distrito Este de Nueva York, denegó la solicitud de Joaquín «El Chapo» Guzmán para tener mayor contacto con su abogado, José Israel Encinosa.
La decisión se basa en dos razones principales: primero, que la corte de Nueva York no es la instancia adecuada para resolver esta petición, ya que las condiciones de encarcelamiento de Guzmán, quien está recluido en la prisión de máxima seguridad ADX Florence en Colorado, son responsabilidad del Buró de Prisiones (BOP) o de la corte federal de Colorado. Segundo, Guzmán no puede presentar solicitudes legales por sí mismo (pro se), ya que cuenta con un abogado designado, y cualquier petición debe realizarse a través de este.
En una carta manuscrita fechada el 15 de julio de 2025, pero presentada el 5 de agosto, Guzmán denunció que, a pesar de una autorización previa de Cogan para que Encinosa lo visitara y contactara por teléfono, no se le ha permitido comunicarse con su abogado durante aproximadamente diez meses, lo que considera vital para su defensa.
Cogan aclaró que cualquier reclamo sobre las condiciones de reclusión debe dirigirse al BOP o a la corte de Colorado, y no aceptará más peticiones directas de Guzmán.
